Visual Presenter Warranty
Promax
warrants its Visual Presenter
to be free from defects in workmanship
and materials under normal use
and maintenance conditions for
a period of two (2) year from
delivery to the original purchaser
by Promax or its authorized
dealer. During such warranty
period, defective equipment
can be returned to Promax Factory
Service Center. If proven to
be defective upon inspection,
Defective equipment will be
repaired or exchanged for new
or comparable rebuilt Equipment.
Warranty replacement shall not
extend the warranty period of
the defective Equipment.
When
returning Equipment to Promax's
Factory Service Center, the
purchaser must pre-pay the shipping
charges, if any and enclose
a bill of sale, copy of warranty
card, or other proof of purchase
together with a complete explanation
of the problem. Equipment covered
by this limited warranty will
be repaired and returned to
the purchaser without charge.
This
warranty does not extend to
used Equipment or to software.
The purchaser will be solely
responsible for obtaining and
installing all required software,
programming design or coding,
as to all of which Promax shall
have no responsibility.
This
warranty shall only apply if
the Equipment is used in conjunction
with compatible computers, peripheral
equipment and software, as to
which items Promax shall have
no responsibility.
NON-PROMAX
BRAND PERIPHERAL EQUIPMENT AND
SOFTWARE WHICH MAY BE DISTRIBUTED
WITH THE EQUIPMENT ARE SOLD
"AS IS', WITHOUT WARRANTY
OF ANY KIND BY PROMAX, INCLUDING
ANY IMPLIED WARRANTY OF MERCHANTABILITY
OR FITNESS FOR A PARTICULAR
PURPOSE. The sole warranty,
if any, with respect to any
such non-Promax brand item is
given by the manufacturer or
producer thereof. Separate warranties
are given for other Promax brand
products, accessories or software
which may be used with the Equipment.
THIS
WARRANTY SHALL BE VOID AND OF
NO FORCE AND EFFECT WITH RESPECT
TO ANY EQUIPMENT WHICH IS DAMAGED
AS A RESULT OF; (A) NEGLECT,
ALTERATION. ELECTRIC CURRENT
FLUCTUATION OR ACCIDENT; (B)
IMPROPER USE, INCLUDING FAILURE
TO FOLLOW OPERATING, MAINTENANCE
AND ENVIRONMENTAL CONDITIONS
PRESCRIBED IN PROMAX'S INSTRUCTION
MANUAL; (C) REPAIR BY OTHER
THAN SERVICE REPRESENTATIVES
QUALIFIED BY PROMAX AND ACTING
IN ACCORDANCE WITH PROMAX'S
SERVICE BULLETINS; (D) USE OF
SUPPLIES OR PARTS (OTHER THAN
THOSE DISTRIBUTED BY PROMAX)
WHICH CAUSE ABNORMALLY FREOUENT
SERVICE CALLS OR SERVICE PROBLEMS;OR
(E) USE OF THE EQUIPMENT WITH
NON-COMPATIBLE COMPUTERS, DEVICES
OR SOFTWARE. NOR DOES THIS WARRANTY
EXTEND TO ANY EQUIPMENT ON WHICH
THE ORIGINAL IDENTIFICATION
MARKS OR SERIAL NUMBERS HAVE
BEEN DEFACED, REMOVED OR ALTERED.
THE
WARRANTY CONTAINED ABOVE IS
IN LIEU OP ALL OTHER WARRANTIES,
EXPRESS OR IMPLIED, INCLUDING
ANY IMPLIED WARRANTY OF MERCHANTABILITY
OR FITNESS FOR A PARTICULAR
PURPOSE, RELATING TO THE USE
OR PERFORMANCE OF THE EQUIPMENT.
NO OTHER EXPRESS WARRANTY OR
GUARANTEE EXCEPT AS MENTIONED
ABOVE, GIVEN BY ANY PERSON,
FIRM, OR CORPORATION WITH RESPECT
TO THE EQUIPMENT SHALL BIND
PROMAX. PROMAX WILL NOT BE LIABLE
FOR PERSONAL INJURY OR PROPERTY
DAMAGE (UNLESS CAUSED SOLELY
BY PROMAX'S NEGLIGENCE), LOSS
OF REVENUE OR PROFIT, FAILURE
TO REALIZE SAVINGS OR OTHER
BENEFITS, EXPENDITURES FOR SUBSTITUTE
EQUIPMENT OR SERVICES, STORAGE
CHARGES, LOSS OR CORRUPTION
OF IMAGE OR DATA, OR OTHER SPECIAL,
INCIDENTAL OR CONSEQUENTIAL
DAMAGES ARISING OUT OF THE USE,
MISUSE OR INABILITY TO USE THE
EQUIPMENT, REGARDLESS OF THE
LEGAL THEORY ON WHICH THE CLAIM
IS BASED AND EVEN IF PROMAX
HAS BEEN ADVISED OF THE POSSIBILITY
OF SUCH DAMAGES. IN NO EVENT
SHALL PROMAX'S LIABILITY HEREUNDER
EXCEED THE SELLING PRICE OF
THE EQUIPMENT TO THE PURCHASER.
WITHOUT LIMITING THE FOREGOING,
THE PURCHASER ASSUMES ALL RISK
AND LIABILITY FOR LOSS. DAMAGE
OR INJURY TO PERSONS AND PROPERTY
OF THE PURCHASER OR OTHERS ARISING
OUT OF USE OR POSSESSION OF
ANY EQUIPMENT SOLD BY PROMAX
NOT CAUSED DIRECTLY BY THE NEGLIGENCE
OF PROMAX. THIS LIMITED WARRANTY
SHALL NOT EXTEND TO ANYONE OTHER
THAN THE ORIGINAL PURCHASER
OF THE EQUIPMENT AND STATES
SUCH PURCHASER'S EXCLUSIVE REMEDY.
Defective
Equipment must be returned to
the Promax Factory Service Center
with all necessary documentation
including proof of purchase.

WARRANTY APPLIES TO EQUIPMENT
SOLD IN THE U.S.A. ONLY.
